Also known as a Rule 91, this extraordinary remedy may, in limited circumstances, be used to raise claims such as actual innocence or claims based on undisclosed evidence.

Post-Conviction Relief

Claims of ineffective assistance of counsel may be raised, which may include a trial attorney’s failure to investigate and present exculpatory evidence at trial or failing to object to otherwise inadmissible evidence presented by the prosecution.

Federal Habeas Corpus

May raise federal constitutional claims which were denied by the state court if the state court's decision involved an unreasonable determination of the facts or an unreasonable application of clearly established federal law.

Post-Conviction Appeal

Involves an appeal to the court of appeals based on the motion court’s denial of post-conviction relief.
